These terms and conditions ("terms") govern your relationship with CAAPA, including, but not limited to, your use of the CAAPA Website https://4caapa.org (the "website"), your purchase of event tickets or program registrations ("programs", "events", "lessons"), your rights to cancel your purchases, your communication with CAAPA, and your use of and attendance at CAAPA facilities.
By accessing, viewing, or using the content, material, products, or services available on or through the Website, you agree to abide by these Terms of Service, which include all of our CAAPA Policies and Privacy Policy, each of which is incorporated by reference as if fully set forth herein and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing this website or using any other services provided by CAAPA.
We, CAAPA, reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page. Any changes to these Terms of Service will take effect immediately from the date of publication.

Accounts

Participant Waiver & Release of Liability
Assumption of Risk and Release
Participation in CAAPA programs, classes, performances, workshops, and events involves physical and artistic activities that carry inherent risks. By registering for and/or attending any CAAPA programs, events, or using CAAPA facilities, you acknowledge and agree that:
You understand the risks associated with performing arts activities including but not limited to vocal training, dance, movement, and live performance
You voluntarily assume all risks of injury, damage, or loss that may result from participation
You have no medical condition that would prevent safe participation in CAAPA activities
You have not been advised by a physician to avoid performing arts activities
You are participating voluntarily and at your own risk
Release and Indemnification
In consideration of being permitted to participate in CAAPA programs and access CAAPA facilities, you hereby release, waive, discharge, and covenant not to sue CAAPA, its board members, officers, staff, volunteers, contractors, and agents from any and all liability, claims, demands, or causes of action arising from your participation in CAAPA activities, except where prohibited by law.
You agree to indemnify and hold harmless CAAPA from any claims made by third parties arising from your participation in CAAPA programs or use of CAAPA facilities.
Photography, Recording & Media Rights
Media Consent
By attending CAAPA events, programs, or entering CAAPA facilities, you grant CAAPA the irrevocable, perpetual, royalty-free right to:
Photograph, videotape, or otherwise record your image, voice, and performance
Use such recordings for promotional, educational, marketing, and archival purposes
Distribute recordings through websites, social media, publications, broadcasts, and other media
Use your name and biographical information in connection with such recordings
Edit, modify, and create derivative works from such recordings
Opt-Out Policy
If you do not consent to recording, you must notify CAAPA staff before participation. Please note that some programs may require recording consent for full participation.
Student Privacy
For participants under 18 years of age, separate parent/guardian consent is required and obtained through registration forms in compliance with applicable privacy laws.
CAAPA Cultural Center (CCC) Usage Terms
Facility Conduct
Use of CAAPA facilities is subject to the following rules:
Respect all equipment, instruments, and property
Follow staff instructions regarding facility use and safety procedures
Report damage or safety concerns immediately to CAAPA staff
No food or drinks in performance areas unless specifically authorized
Maintain appropriate behavior consistent with CAAPA's mission and community standards
Damage Responsibility
Participants are liable for damage caused by negligent or intentional acts
CAAPA may charge repair/replacement costs for damaged property or equipment
Lost or stolen personal items are participant's sole responsibility
CAAPA is not liable for damage to participant's personal property
Facility Access
Access is limited to scheduled program times unless specifically authorized
Participants must vacate facilities promptly after programs end
Emergency procedures are posted throughout facilities and must be followed
Unauthorized access to restricted areas is prohibited
Performance & Artistic Content Terms
Artistic Standards
CAAPA reserves the right to determine artistic content, casting, and performance participation based on program requirements and organizational mission to promote diversity in classical performing arts.
Performance Rights
By participating in CAAPA performances, you grant CAAPA rights to:
Record and broadcast performances for promotional and archival purposes
Use performances in marketing materials, grant applications, and fundraising efforts
Include your name in programs, promotional materials, and donor communications
Content Guidelines
All participant content (songs, compositions, choreography) must align with CAAPA's mission and community standards. CAAPA reserves the right to approve or reject content that does not meet program requirements.
No Guaranteed Participation
Program registration does not guarantee performance opportunities, specific roles, or solo opportunities. Participation is subject to program capacity and artistic requirements.
Minors and Parental Responsibility
Age Requirements
Programs specify minimum and maximum age requirements that must be met for participation. Age verification may be required at registration.
Parental Consent
Parents/guardians of minor participants must:
Complete all required consent, medical, and emergency contact forms
Acknowledge risks outlined in these Terms and provide authorization for emergency medical treatment
Understand pickup/drop-off procedures, timing, and late pickup policies
Provide accurate contact information for program communications
Supervision Policy
Parents are responsible for transportation to and from programs
CAAPA provides supervision only during scheduled program hours
Late pickup fees may apply as outlined in program-specific policies
Communication
Important program information will be communicated to the parent/guardian contact provided at registration. Parents are responsible for checking communications regularly.
Accuracy of Materials
The materials appearing on our website are not comprehensive and are for general information purposes only. CAAPA does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on this website, or otherwise relating to such materials or on any resources linked to this website.
Termination
We may terminate or suspend your access to all or any part of our Services at any time, with or without cause, with or without notice, effective immediately. We may suspend or terminate your right to use our website and terminate these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.
If you wish to terminate the Agreement or your CAAPA account, you may simply discontinue using our Services.
All provisions of the Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Our Services are provided "AS IS" and "AS AVAILABLE" basis. CAAPA and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither CAAPA, nor its suppliers and licensors, makes any warranty that our Services will be error-free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.
To the extent permitted by law, CAAPA makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.
In no event shall CAAPA or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if CAAPA or an authorized representative has been notified, orally or in writing, of the possibility of such damage.

Jurisdiction and Applicable Law
Except to the extent any applicable law provides otherwise, the Agreement and any access to or use of our Services will be governed by the laws of Maryland.
The proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our Services will be the state and federal courts located in Maryland.
These Terms of Service are governed by and construed in accordance with the laws of Maryland. You irrevocably submit to the exclusive jurisdiction of the courts in that State.
Severance
Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.
Changes
CAAPA reserves the right, at our sole discretion, to modify or replace these Terms at any time.
If we make changes that are material, we will let you know by posting on our website, or by sending you an email or other communication before the changes take effect. The notice will designate a reasonable period of time after which the new terms will take effect.
If you disagree with our changes, then you should stop using our Services within the designated notice period, or once the changes become effective.
Your continued use of our Services will be subject to the new terms.
